Terms & Conditions

§ 1 Scope

(1) These General Terms and Conditions ("GTC") apply to all contracts between FindMyDrive24 UG (haftungsbeschränkt) ("Provider") and consumers within the meaning of § 13 BGB (German Civil Code).

(2) The Provider operates an online platform on which users can list, search for, and find vehicles.

(3) In addition, the Provider offers a paid vehicle inspection service.

§ 2 Service Description

(1) Platform use

• The Provider makes available a technical platform through which users may publish vehicle listings and contact other users.
• The Provider is neither seller, buyer, nor dealer of any vehicles offered on the platform.
• Purchase contracts are concluded exclusively between the respective users.
• The Provider assumes no guarantee for the accuracy of listings, the identity or creditworthiness of users, the actual condition of vehicles, or the conclusion of a purchase contract.

(2) Vehicle listings

• Vehicle listings can be published for 30 days at the applicable fee.
• Listings are automatically deactivated after 30 days. A paid renewal is possible.
• No refund is issued for early deletion or deactivation.

(3) Vehicle inspection

• The Provider offers a paid vehicle inspection service carried out by inspectors.
• The inspection is based on a visual examination and features discernible at the time of inspection.
• The vehicle inspection does not constitute an expert appraisal.
• No guarantee or warranty is given for hidden defects, actual condition, or future value development.

§ 3 Contract Formation

(1) By booking a listing or vehicle inspection the customer submits a binding offer.

(2) The contract is formed upon payment confirmation or explicit acceptance by the Provider.

(3) Payment is made exclusively online and in advance.

§ 4 Prices and Payment

(1) The prices stated at the time of booking apply. Payment is due immediately.

(2) No publication or appointment is made without prior payment.

§ 5 Duration and Cancellation

Vehicle listings: 30-day term, no automatic renewal, no refund for early termination.

Vehicle inspection:

• Free cancellation up to 48 hours before the appointment.
• No refund for cancellations made less than 48 hours before the appointment.
• Cancellations must be made through the user account under "My Bookings".

§ 6 Right of Withdrawal

The right of withdrawal for digital listings lapses upon publication of the listing.

§ 7 User Obligations

• Users must provide truthful and complete information.
• Unlawful content, false listings, or misleading information are prohibited.
• No copyrighted materials may be uploaded without authorisation.
• Automated queries (bots, scrapers) are not permitted without prior written approval.

The Provider reserves the right to remove content or suspend accounts in the event of a breach of these GTC.

§ 8 Liability

(1) The Provider is fully liable for intent and gross negligence.

(2) For slight negligence, liability is limited to breaches of material contractual obligations and capped at foreseeable, contract-typical damages.

(3) The Provider is not liable for purchase contracts concluded between users, nor for economic decisions made by users on the basis of a vehicle inspection.

§ 9 Data Protection

Personal data is processed in accordance with the GDPR. For details please refer to our Privacy Policy.

§ 10 Governing Law and Jurisdiction

German law applies. The place of jurisdiction is Munich, Germany, to the extent permitted by law.

§ 11 Severability

Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a valid provision that comes closest to the intended economic purpose.
